Visa and Mastercard $167.5 Million ATM Fee Settlement: How You Could Get Paid

If you have withdrawn cash from an independent ATM over the last two decades, you might be owed a piece of a major legal payout.

Visa and Mastercard have agreed to a $167.5 million class-action settlement following allegations of inflated ATM surcharges.

The lawsuit, Burke v. Visa Inc., centers on non-bank ATMs typically located in convenience stores, gas stations, grocery stores, hotels, and bars.

Plaintiffs claimed cardholders nationwide paid excessive, non-reimbursed withdrawal fees that violated federal and state antitrust laws.

Court filings show independent operators were allegedly blocked from routing transactions through cheaper, competing card networks that could have lowered customer fees.

Both card networks chose to resolve the long-standing litigation through a financial settlement without admitting any wrongdoing.

To qualify for a cash payment, you must have used a Visa or Mastercard debit card to withdraw cash at an independent U.S. ATM between Oct. 24, 2007, and Aug. 14, 2026.

You must have also paid an out-of-pocket access fee or surcharge that was not fully reimbursed by your bank.

The total payout each class member receives will depend entirely on how many valid claims are submitted before the deadline.

Eligible consumers can file, object to, or opt out of the settlement online at nonbankatmsurchargesettlement.com.

All claim forms must be submitted by Feb. 10, 2027, with payments expected to distribute after a final court approval hearing in early 2027.
